The ability to recover debt without going to court is now a reality. Traditional litigation in a local courthouse is often not worth the money spent and can take months, if not years.

With over $645 billion spent in the US every year on litigation and 7.2 million new cases registered annually, it is no wonder that the US court system has ground to a halt.

Ejudicate is a pioneering online dispute resolution platform that allows businesses to recover owed debt at a fraction of the cost of traditional litigation and in a much more timely manner.

Most importantly, Ejudicate allows you to recover debt without going to court.

The process is simple and can be broken down into six easy steps, from submitting written evidence to the issue of a binding award that can be reduced to an enforceable court judgment.

One of the things that sets Ejudicate apart from any other arbitration service is that the plaintiff is given an upfront fee (which is a fraction of the traditional cost of litigation) as soon as the preliminary documentation is uploaded to the portal.

This allows the plaintiff to know its total costs, up-front, and make a solid and informed decision as to  whether it makes economic sense to pursue the claim or not.

The six-step Ejudicate process

1. File claims online

Ejudicate’s platform allows users to submit their claims exclusively online.

What’s more, plaintiffs are given an up front flat fee, based on the amount of the claim and whether the defendant chooses to participate in the process.

At the outset, the plaintiff is  invited to submit any evidence to support their claim.

  • Register
  • File claim
  • Upload supporting evidence

2. Defendant is served claim by email

Once the fee is determined and the evidence uploaded, Ejudicate notifies the defendant of the claim made against them by email and certified mail and invites them to submit their defense.

This process is managed 100 percent online and requires no input from the plaintiff.

  • Ejudicate notifies defendant by email
  • Ejudicate notifies defendant by certified mail
  • Defendant submits their defense

3. Litigants counter

Just like in a bricks and mortar court, each party to the claim is invited to scrutinise the other’s assertions.

The plaintiff and defendant are invited to counter each other’s claim in writing on Ejudicate’s online platform.

  • Ejudicate contacts plaintiff and defendant inviting counter arguments
  • All done 100 percent online through Ejudicate’s platform

4. Ejudge is assigned

Once the initial process is finalised, an Ejudge (arbitrator) is assigned based on jurisdiction, skills, and expertise in the subject matter.  The Ejudge will also ensure that he or she has no conflict of interest.

The Ejudge will gather all preliminary submissions, counter-arguments and notes on the process before evaluating the claim

  • Ejudge assigned according to jurisdiction and subject matter expertise.
  • Ejudge clears conflicts.

5. Ejudge reviews evidence

Once the Ejudge is assigned, he or she will review all of the evidence put forward by the parties to the claim.

Discovery, however, is left in the hands of the Ejudge, not the parties so as to save time and money by eliminating “fishing expeditions” and discovery motion practice.

The judge, rather, can question the litigants through the platform and narrow his or her inquiry to pertinent facts and issues.

Unless the Ejudge feels that live testimony is needed, this is all done in writing  through the Ejudicate portal.

  • Ejudge reviews the evidence
  • Any questions submitted to the litigants

6. Award issued

After evaluating all of the evidence, the E-Judge will issue an Award which can be filed with the court to be reduced to an enforceable judgment.

  • Ejudge issues binding award
  • Parties are  sent notification of award
  • Prevailing party may file award in court
